These Terms of Use (“Terms”) govern your access to and use of the website www.salonat10newbury.com (the “Site”) and the salon services described on the Site, operated by The Salon at 10 Newbury (“the Salon,” “we,” “us,” or “our”), located at 10 Newbury Street, Boston, MA 02116, United States. By accessing the Site, submitting a consultation request, booking an appointment, subscribing to our newsletter, or otherwise engaging with us through the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About Us
The Salon at 10 Newbury has served the Boston community since 1995, offering professional hair-care, hair-color, and hair-replacement services. The Salon and its practitioners are licensed by the Commonwealth of Massachusetts Board of Registration of Cosmetology and Barbering. 2. Eligibility
The Site is intended for use by individuals who are 18 years of age or older, or 16 years of age or older with the consent of a parent or legal guardian. By using the Site you represent that you meet this requirement. Services may be provided to minors only when accompanied by, or with prior written authorization from, a parent or legal guardian.
3. Description of Services
Through the Site, we provide:
- Information about our salon services, stylists, and pricing
- The ability to request a complimentary in-salon consultation
- Newsletter subscription and educational content about hair care and hair-replacement options
- Links to our social-media channels and to third-party tools (such as scheduling or payment platforms) used in connection with our services
Submitting a consultation request or contact form through the Site does not create a confirmed appointment. An appointment is confirmed only after our staff contacts you directly by phone, text message, or email to schedule a specific date and time.
4. Appointments & Bookings
Our current business hours are:
- Tuesday: 9:00 AM – 4:00 PM
- Wednesday – Thursday: 11:00 AM – 7:00 PM
- Friday – Saturday: 9:00 AM – 5:00 PM
- Sunday – Monday: Closed
Service availability, stylist schedules, and posted pricing are subject to change without notice. Final pricing for any service is confirmed at consultation and depends on factors including hair length, density, condition, complexity of color formulation, and product usage.
5. Cancellation & No-Show Policy
We respectfully ask for advance notice if you need to cancel or reschedule an appointment, so we may offer the time to another client.
- Standard cancellation notice required: 48 hours
- Late cancellation fee (less than the notice period): 50% of the scheduled service total
- No-show fee: 100% of the scheduled service total
- Same-day rescheduling: available subject to stylist availability and may be subject to a late-cancellation fee
A valid credit or debit card may be required to secure certain appointments, particularly for color services, hair-replacement consultations, and bookings of two hours or longer. Cancellation fees will be charged to the card on file.
6. Pricing & Payment
All prices are quoted in United States Dollars (USD) and are subject to applicable Massachusetts sales tax where required. We accept major credit and debit cards, cash, and other forms of payment displayed at the front desk. Payment is due in full at the conclusion of each service.
Online listings of prices are provided as estimates. Custom hair-replacement systems, color corrections, and other specialized services are quoted individually at consultation, and a deposit may be required before service begins.
7. Refunds, Adjustments & Service Guarantees
Salon services are personal and non-refundable once rendered. However, we stand behind our work. If you are not satisfied with a service, please contact us within 7 days, and we will arrange a complimentary adjustment with the same stylist or, at our discretion, with a different team member.
Retail products purchased at the Salon may be returned, unopened and in original condition, within 14 days for a full refund or store credit. Opened products may be exchanged for store credit at our discretion if you experienced an allergic reaction or product defect.
Custom hair-replacement systems and made-to-order wigs are non-refundable once production has begun. Deposits for custom orders are non-refundable. Full terms of any custom order are documented in a separate written service agreement signed at consultation.
8. Gift Cards
Gift cards purchased from The Salon at 10 Newbury are redeemable for services and retail products at the Salon. Gift cards are non-refundable, may not be redeemed for cash (except where required by Massachusetts law), and cannot be replaced if lost or stolen. Unused balances remain valid in accordance with Massachusetts gift-card law.
9. Consultation Forms, Newsletter & Communications
When you submit a consultation request, contact form, or newsletter signup through the Site, you consent to be contacted by The Salon at 10 Newbury by email, phone, or text message in response to your inquiry and, if you have opted in, for occasional marketing communications.
You may unsubscribe from marketing emails at any time using the unsubscribe link in any message we send. To opt out of text-message marketing, reply STOP. Transactional messages relating to confirmed appointments (reminders, schedule changes) are sent regardless of marketing-opt-in status; if you do not wish to receive them, please notify us and we will arrange an alternative contact method.
Our use of personal information you submit is governed by our Privacy Policy.
10. User-Submitted Content & Reviews
Where the Site enables you to submit content — including consultation forms, contact messages, social-tagged photographs, comments, or third-party reviews — you grant The Salon at 10 Newbury a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for the purpose of providing services to you and operating our business (including reasonable display on our website, social-media channels, and printed marketing materials, with prior notice where required by law).
You represent that any content you submit is your own, accurate, and does not infringe the rights of any third party. We reserve the right to remove content that we determine, in our sole discretion, to be unlawful, defamatory, off-topic, or otherwise inappropriate.
11. Salon Conduct & In-Person Behavior
While these Terms primarily govern your use of the Site, when you visit our Salon we also ask that you:
- Arrive on time for your scheduled appointment
- Disclose any allergies, sensitivities, medical conditions, or recent medications relevant to your service, including but not limited to chemotherapy, radiation, recent surgery, pregnancy, and prior chemical hair treatments
- Treat our staff and other clients with courtesy and respect
- Refrain from photographing, video recording, or audio recording other clients without their consent
- Respect the privacy of clients receiving hair-replacement services or wig fittings
We reserve the right to refuse or discontinue service to any individual whose conduct we determine to be unsafe, harassing, or disrespectful to our staff or clients.
12. Intellectual Property
All content on the Site — including text, photographs, graphics, the salon logo, video, audio, and original styling work depicted in portfolio images — is the property of The Salon at 10 Newbury or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. You may view, download, and print Site content for personal, non-commercial use only. Reproduction, distribution, public display, modification, or commercial use without our prior written consent is prohibited.
Third-party trademarks (for example, the brands of professional hair-care products carried in the Salon) remain the property of their respective owners and are used here for descriptive purposes only.
13. Third-Party Services & Links
The Site contains links and embedded content from third-party services, including but not limited to social-media platforms (Facebook, Instagram, YouTube, Twitter / X, Yelp), online review platforms, scheduling and payment processors, and product manufacturers. Your interaction with those services is governed by their own terms of service and privacy policies. The Salon at 10 Newbury does not endorse, control, or assume responsibility for third-party services.
14. Disclaimers
The Site and all content provided through it are made available on an “as is” and “as available” basis, without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Nothing on the Site constitutes medical, dermatological, or other professional advice. For complete disclaimers — including information about hair-care results, allergens, hair-replacement services, before-and-after imagery, and AI-assisted content — please see our Disclaimer.
15. Limitation of Liability
To the maximum extent permitted by the laws of the Commonwealth of Massachusetts, The Salon at 10 Newbury, its owners, employees, contractors, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising from or related to:
- Your use of, or inability to use, the Site
- Your reliance on any information provided through the Site
- Any service booked through the Site, except to the extent caused by our gross negligence or wilful misconduct
- Unauthorized access to or alteration of your submissions
Where any limitation of liability cannot be excluded under applicable law, our total aggregate liability to you for any claim arising from or relating to these Terms or the Site shall not exceed the amount you have paid to us for services in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars (USD 100), whichever is greater.
16. Indemnification
You agree to indemnify, defend, and hold harmless The Salon at 10 Newbury, its owners, employees, and contractors from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; (c) your violation of any third-party right, including intellectual-property or privacy rights; or (d) any content you submit through the Site.
17. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or applicable law. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms, the Site, or any service provided by The Salon at 10 Newbury shall be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
19. Informal Dispute Resolution
Before initiating any formal legal action, you agree to first contact us in writing at thesalonat10newbury@gmail.com and provide a brief description of the dispute and your contact information. We will make a good-faith effort to resolve the matter within thirty (30) days of receipt. This informal-resolution step is a precondition to any formal proceeding, except for claims that may be brought in small-claims court.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and The Salon at 10 Newbury regarding your use of the Site, and supersede any prior or contemporaneous agreements on the same subject matter. Written service agreements signed at consultation for custom orders take precedence over these Terms with respect to those specific orders.
22. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, where the change is material, provide additional notice through the Site or by email. Continued use of the Site after any revision constitutes your acceptance of the updated Terms.
